Is it my imagination or does hail storm miss sometimes?? not fizzle mind you just miss?? if so why ?? also is there a known issue with it not working on provoed creatures?

Yes sadly they fucked up in some recent patch , some aoe do not work on provocated creatures anymore , like wither, hailstorm , etc im probly missing more aoe spells that doesnt work anymore on those provocated mobs.. would need to do a bug report .... @Kyronix
